The KGMP managing partner Att. Pepa Marnikas took part in the ‘Challenges facing e-commerce retailers’ Seminar, held on November 19, 2019 in Sofia. The event was organized by the Еnterprise Europe Network, the Bulgarian Chamber of Commerce and Industry, the European Consumer Centre and the Bulgarian Commission for Consumer Protection.
The seminar was aimed at companies wishing to grow their business and distribute their goods and services in Bulgaria and abroad through online channels, as well as their legal advisers.
During the seminar, participants were introduced to the latest developments in consumer protection legislation, the rules on warranties and guarantees operating within the member states of the European Union, as well as the possibilities for alternative dispute resolution between online merchants and consumers by conciliation committees, which are administered by the Commission for Consumer Protection.
As well, Mr. Ignat Arsenov, Director of the Market Control Directorate at the Commission for Consumer Protection, shared some interesting case studies and highlighted the most common mistakes made by online retailers.
Among the main topics discussed during the seminar were the mandatory information on the online merchant’s website, the process of placing an order on a website and pre-contractual information requirements, the cooling-off period for returning a product and return costs, complaints procedures and redress, the consumer’s right to cancel the online purchase contract, etc.
The issues of applicable law and the competent courts for cross-border e-commerce disputes within the European Union also aroused great interest among the participants.
During the event, e-commerce retailers and their legal advisers shared their experience and best practices in the field of e-commerce.
